If you have been charged with an OVI, or “operating a vehicle impaired”, it is important that you take these charges seriously. Understanding OVI Charges in Cincinnati

In Cincinnati and throughout Ohio, it is illegal to operate a vehicle while intoxicated or while having a blood alcohol content level, or BAC, of 0.08% or greater. For minors, or individuals under the legal drinking age of 21, if any amount of alcohol at 0.02% or higher is found, they can be charged with an OVI. According to a recent study, Ohio sees 128.9 drunk driving arrests each year per 100,000 people.

In addition to alcohol-related OVI charges, you can also be charged with an OVI if you have certain controlled substances in your system while operating a vehicle. These controlled substances include:

  • Cocaine
  • Heroin
  • Methamphetamine
  • Marijuana
  • LSD
  • Phencyclidine

Defenses to OVI Charges

While every OVI case is different, there are some defense strategies that can be applied in many situations. At Blackney Law, we make it our mission to have your OVI charge reduced or even dismissed. We can do that by implementing one or more of the following defense strategies:

  • You suffered an unlawful traffic stop of your vehicle without the police having any kind of probable cause or reasonable suspicion to pull you over.
  • The police who arrested you failed to read you your Miranda Rights.
  • The chemical or field sobriety tests were improperly administered.
  • There was no probable cause for your arrest.
  • Your signs and symptoms are actually caused by non-alcohol conditions, such as those involved with certain health issues.
  • Your constitutional rights were violated during the traffic stop, your arrest, or your interrogation.
